Please read these Terms of Service (“Terms”) carefully before using the Rivvet email health research alert service (“Service”) operated by Rivvet LLC, a Delaware limited liability company (“Rivvet,” “we,” “us,” or “our”).

By subscribing to or using the Service, you (“you” or “User”) agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

RIVVET DOES NOT PROVIDE MEDICAL ADVICE. ALL CONTENT DELIVERED THROUGH THE SERVICE IS FOR INFORMATIONAL PURPOSES ONLY AND IS NOT INTENDED AS A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. 1. Description of Service

Rivvet is a free email service that delivers curated summaries of publicly available health research to subscribers based on their selected health condition preferences. The Service may include affiliate links to third-party healthcare scheduling platforms, including Zocdoc.

The Service is provided at no cost to Users. Rivvet may earn referral fees from bookings made through affiliate links included in our emails (see Section 7, Affiliate Disclosure).

2. Eligibility

2.1 Age Requirement

You must be at least eighteen (18) years of age to use the Service. By subscribing, you represent and warrant that you are at least 18 years old. If we learn that a User is under 18, we will promptly terminate their account and delete their data.

2.2 Washington State Exclusion

The Service is not available to residents of the State of Washington. Due to Washington's My Health My Data Act (MHMDA) and its private right of action provisions relating to the collection and use of health-related data, Rivvet has determined that it cannot offer the Service to Washington residents at this time. By subscribing, you represent and warrant that you are not a resident of the State of Washington.

3. User Responsibilities

By using the Service, you agree to:

  • Provide accurate information, including your email address and state of residence.
  • Not rely on content as medical advice. All content is for general informational purposes only.
  • Consult a qualified healthcare provider before making any decisions about your health.
  • Maintain the confidentiality of your account.
  • Not use the Service for any unlawful purpose.

4. Intellectual Property

All content, branding, logos, designs, and materials associated with the Service are the property of Rivvet LLC or its licensors. Research summaries are curated and summarized by Rivvet. The underlying research is the property of the respective authors and publishers.

5. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement. Rivvet makes no medical claims and provides no medical warranties of any kind.

6. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Rivvet, its member, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages. In no event shall Rivvet's total aggregate liability to you exceed one hundred dollars ($100.00).

7. Affiliate Disclosure

Rivvet participates in affiliate programs and may include affiliate links in emails. When you click on an affiliate link and book an appointment, Rivvet may earn a referral fee. This fee is paid by the affiliate partner and does not increase the cost of any service you receive. The inclusion of affiliate links does not constitute an endorsement of any particular healthcare provider.

8. Third-Party Links and Services

The Service may contain links to third-party websites or services. Rivvet is not responsible for the content, privacy practices, or terms of use of any third-party sites or services.

9. Dispute Resolution and Arbitration

These Terms shall be governed by the laws of the State of Delaware. Any dispute shall be resolved through final and binding arbitration administered by the American Arbitration Association. You and Rivvet agree that each may bring claims only in individual capacity and not as a plaintiff or class member in any class action. You may opt out of arbitration within thirty (30) days of subscribing by emailing support@rivvethealth.com.

10. Termination

You may terminate your use at any time by unsubscribing. We may terminate or suspend your access at any time, including if you breach these Terms or are determined to be a Washington State resident.

11. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email. Continued use after notice constitutes acceptance.
